MURRAY OFF TO A RECORD-SETTING START IN 2020

2020.09.21 16:20 texasalaskamontana NBA Left Charlotte & Indianapolis Markets Out of NBA MVP/Awards Voting

After reviewing all 100 NBA media voters it appears the NBA left the Charlotte and Indianapolis media markets out of the 2020 NBA Awards balloting.
There's no publicly written rules for the makeup of NBA media voting. When the league announced reforms in 2017 one of the reported intents was to include an independent media member from every NBA market. Many markets were heavily dependent on local TV and radio broadcasters who are actually employees of the team and the league removed them from the pool.
But here in 2020 the league didn't stick with that rule. It has happened to other markets in recent years. This year it's pretty egregious as both Charlotte and Indiana media markets were represented in January NBA All-Star media voting by the following reporters...
When it came time to cast votes for the NBA Awards neither of these voters were given a ballot nor were they replaced in the voting pool with a different local media member.
Hell, even Reggie Miller was pulled from the voting pool this year denying the Pacers a media member who spent his career with the team.
Charlotte --
In past seasons the Charlotte media market vote was held by Richard Walker previously with the Gaston Gazette. Walker has covered the Hornets since their founding for many publications but was at a smaller outlet and was given the vote for either his emeritus status as an NBA writer or the limited eligibility of other members of the media market.
Several markets have publications which don't allow voting on awards. The Charlotte Observer, despite being the market's largest newspaper and having a dedicated Hornets beat writers, appears to be one of those. Other examples are the Washington Post, New York Times, and Houston Chronicle.
Walker also left the Gaston Gazette to start his own website covering local sports which likely rules out his eligibility as he no longer works for an established outlet.
So Boone was laid off, Walker had started his own website, and the Observer doesn't allow voting. Is it possible that didn't leave anyone in the media market who was eligible to vote in the eyes of the NBA? Or that they didn't look hard enough or consider established alternatives?
If someone in the comments can identify a writer in the market who could have had the vote I'd appreciate it. I failed in this attempt.
Indiana --
Scott Agness was laid off by The Athletic in June and surpringly the NBA did not keep the awards ballot in Indy by passing it to the Indianapolis Star.
This doesn't make sense as the Pacers beat writer for the Indy Star is J. Michael Falgoust. Who once held an MVP ballot during his time with CSN Washington in the DC media market.
Falgoust cast an MVP vote in 2017. The league's most contentious recent election. He was one of nine voters who zagged for Kawhi Leonard in first place over both Harden and Westbrook. In 2019 he was also given an All-Star ballot while at the Indy Star.
If you drop Falgoust from the equation this situation still feels like an outright denial as the Indy Star's beat writer has routinely held an NBA Awards ballot in the past: Clifton Brown in 2018 and Nate Taylor in 2017.
Charlotte makes some sense, but Indy just feels like they got stood up on a date. It doesn't make sense why there wouldn't be an Indianapolis vote with the option that existed for the NBA.
Sorry Charlotte and Indy. It feels like the league did you wrong.

2020.09.17 17:45 ketchupsunshine As requested: Paula Abdul claims a 1992 plane crash took her out of the spotlight. The NTSB has no record of it ever happening.

On the Paula Abdul post a couple weeks ago, I commented that I had a write-up that was almost ready to go. This goes far more in depth than that post and was heavily requested so hopefully it does not get removed this time.
In July I saw this comment and decided to look up the plane crash story, expecting it to be easily explainable one way or another. But instead I wound up with differing accounts from Paula Abdul herself, articles claiming she was lying, and lots of random gossip. So I figured I’d try to piece it together myself.
The story goes like this:
In 1992 1, Paula Abdul was flying from a performance in St. Louis to Denver while on her Under My Spell Tour (sometimes called the “Spellbound” tour, the name of the album she was promoting at this time). Then, over a cornfield in Iowa, Abdul in 2019 said the following took place:
“It all happened when I boarded a seven-seater plane and an hour into the flight one of the engines blew up and the right wing caught fire and everything went black...I woke up in the hospital only to find that I had crushed my cervical spine, leaving me partially paralyzed.”
She also stated that she underwent 15 spinal surgeries as a result of her injuries both from this and prior incidents.
But 2019 was not the first time she told this story. According to Abdul in 2005, she took one day off and she continued to perform. The 2005 account mostly matched her earliest mention of the accident in 2003. Then, in 2019, she described waking up in the hospital, partially paralyzed. The story changes in bits every time, and there is no documented mention of it at all before Abdul’s 2003 NBC interview. It’s stranger the more you read about it, and there don’t seem to be concrete answers.
What we do know for sure is that Paula Abdul’s career took a hit shortly after the time she claims the crash took place. Abdul’s next era following Spellbound, Head Over Heels, was her worst selling release. She was divorced twice between 1994 and 1998. Between her Spellbound era and about 1996, Abdul seemed to stay out of the spotlight. Part of this was due to her seeking treatment for her bulimia in 1994, which came with rumors that she was being treated for opioid addiction at the same time. Her career and personal life seemed to have gone downhill after her Under Your Spell tour, and it’s debated whether this was because of her plane crash, or whether the plane crash was invented to sweep this under the rug.

Inconsistencies:

There are a few aspects of Abdul’s story that are pointed to as proof that she is lying.
Dates:
Abdul claims to have performed in St. Louis before the fateful flight, heading to Denver, and to have boarded immediately following this performance. Her own website does not list a St. Louis tour date (although there is a date for Greenwood Village, near Denver, on June 10, 1992). The Wikipedia page for the tour uses the same dates as Abdul’s website. This has been used by some theorists as proof that the whole story is fabricated, since it gives the appearance that there wouldn’t have been a St. Louis to Denver flight at all. However, while Abdul’s own website lacks any mention of these dates, there is some evidence she may have flown from St. Louis to Denver between June 19 and June 22, 1992. 2 Rich Juzwiak at Jezebel dug up records that give us a possible date for the alleged crash. The Jezebel article cites a St. Louis Post Dispatch article from June 21, 1992, talking about a Paula Abdul concert the previous Friday at the Riverport Ampitheater. This sets a date of June 19, 1992 for St. Louis. The same Jezebel article also cites an Entertainment Weekly article from September 25, 1992, which refers to Abdul performing a show at the Fiddler’s Green Amphitheatre in a suburb of Denver on June 22. Abdul’s website lists no shows between the June 10 show in Greenwood Village and the June 23 show in Seattle. This means that there is a gap that these other two shows fit into, although it is odd they aren’t listed as part of the tour despite being part of the tour.
EDIT: As referenced in footnote 2, the Jezebel article had an edit claiming that a reader had found a Kansas City Star article listing a June 20, 1992 date at the Sandstone Ampitheater in Bonner Springs, outside of Kansas City. I couldn't find this as I was writing, but u/bookdrops dug up this Springfield News-Leader article from June 19, 1992 that references the same June 20 date at the Sandstone Ampitheater. This means that there was a date between the St. Louis and Denver shows that have been found, and to me this rules out there being a St. Louis to Denver flight at all. She could have mistaken Kansas City for St. Louis or misremembered, but her stated flight path doesn't seem to have happened.
Possible drug addiction:
Abdul’s 2009 Ladies Home Journal interview describes her spending Thanksgiving 2008 weaning herself off of a painkiller addiction:
The rumors that her sometimes-bizarre behavior was fueled by drugs just may have been true. Abdul was taking heavy-duty pain killers, though she claims she never shot an Idol episode under the influence. But last Thanksgiving, determined to overcome her habit, she checked into the La Costa Resort and Spa, in Carlsbad, California, to wean herself off her medications in one fell swoop. "I could have killed myself.... Withdrawal -- it's the worst thing," she says. "I was freezing cold, then sweating hot, then chattering and in so much pain, it was excruciating. But at my very core, I did not like existing the way I had been.”
Fans and tabloids during Abdul’s run as an American Idol judge often commented on her strange behavior, although she was quick to explain it away. The LHJ interview had direct quotes from her talking about her struggle with drug addiction.
...And then Paula Abdul went on record saying she had never said those things. In fact, according to her, she has never even been drunk. Abdul does not seem to have refuted that she went to a place called La Costa in Carlsbad, California, but she was adamant that it was just a normal spa and she had been there for only three days. While there is a rehab center in Carlsbad called La Costa, the article refers to “La Costa Resort and Spa”, which is an actual resort and spa.
Despite Abdul’s denials, there is still rampant speculation that she is or was addicted to painkillers. There’s certainly no clear-cut evidence proving she was ever an addict, but it’s also nearly impossible to disprove something. Especially when there is so much circumstantial evidence, such as her “strange” behavior that the tabloids latched onto.
Worth noting for this point is the fact that Abdul has consistently been open about her diagnosis with Reflex Sympathetic Dystrophy, an incredibly painful condition. This, in conjunction with her (also consistent) story about a cheerleading accident in high school followed by several smaller car accidents over the years, means that Paula Abdul already has a pretty good reason to be using painkillers. RSD and any severe chronic pain can sometimes also cause people to seem “spacey” or “loopy”, which could also explain why so many people thought she was acting strange during the time she was on American Idol.
Crash records:
The strongest piece of evidence cited by those who believe Paula Abdul is lying is the lack of evidence. There seems to be no record of this crash ever having happened. Her tour ran from October 1991 to August 1992 and despite having searched accident records 3 for that timespan I have been unable to find any record of this crash. I’ll admit to not being knowledgeable about aviation records, but it also seems telling that no one else has been able to find these records either. Abdul has denounced those who doubt her claims and while I can’t speak definitively, I would think she or her publicist would have pointed to an NTSB report if there was one.
Additionally, Abdul has been quoted several times as saying the plane landed in a cornfield in Iowa. This doesn’t fit with her claim that the flight was from St. Louis to Denver. The flight she claims to have taken is pretty much straight west, and crashing in Iowa would require a significant detour north. Not impossible, but certainly implausible at least from a layman’s understanding of air travel.
There is an NTSB report for an eight seater (not seven) plane crashing into a field in Nebraska (not Iowa), a full month before the Under My Spell tour began. It also seems to have taken off in Nebraska with an intended destination elsewhere in Nebraska, rather than going to either St. Louis or Denver, and it crashed shortly after takeoff rather than the claimed forty minutes to an hour into the flight. I cannot find any news about what Abdul would’ve been doing in Nebraska in September 1991, so I don’t believe this is the accident. There is also a record of an accident in Englewood, Colorado on June 10, 1992. Paula Abdul had a concert in nearby Greenwood Village on the same day, but the description of the plane and accident do not match her story at all. These two are the only records that I have seen that match any part of her story, and neither is a good fit.

Theories:

Theory 1: Paula Abdul was actually in some sort of incident on a plane in 1992, but has embellished what happened and this is why no one has been able to track down records of the event. The most common theory in this camp is that the plane experienced some turbulence, she wasn’t wearing her seatbelt, and she experienced an injury. This possibly compounded with previous injuries (such as the cheerleading accident she often mentions in conjunction with the plane crash story) and caused severe harm, but the plane did not crash. There’s a lot of overlap between this theory and the others, and how much overlap exists between theories depends on who you ask.
Theory 2: Paula Abdul was not in any aviation accidents in 1992 and she is using this story to cover up painkiller use and/or her extended absence from the limelight before her American Idol job.
One of these theories revolves around the idea that Paula invented the plane crash in 2003, after regaining the limelight as an American Idol judge, to give herself an excuse for falling out of the public eye and to distract from the downturn in her career and personal life during this period. The other, more popular theory, is that she used the plane crash as an excuse to either explain away her loopy behavior during her American Idol years as non-drug related (if you believe 2005 USA Today “I have never been addicted to anything” Paula Abdul) or to excuse it as being caused by medication prescribed to her for her injuries.
Theory 3: Paula Abdul is telling the truth about being in a crash and her story was brought into doubt due to some unfortunate gaps in information, such as the NTSB records being incomplete/the accident not being reported at all, her own choice to keep quiet for an extended period of time, and miscommunications about whether or not she was using pain medication. There is enough room for the basic story to be true. Admittedly, the story has changed so much that at least some versions will be lies even if one version was the truth. If this is the case I will certainly apologize for fueling speculation otherwise...but I would consider this the least likely option.

Conclusion/discussion:

Regardless of whatever the actual story is regarding the plane crash, it’s pretty clear that Paula Abdul struggles with chronic pain and I do not intend to make light of this at all or to shame her if she has struggled with addiction. It’s just very strange that there is no proof of this event ever happening. Did Paula Abdul get injured on a plane in 1992? Was she covering for a painkiller addiction, and was that part of why she went to rehab in 1994? Was she covering for being out of the spotlight? Is Paula Abdul actually sober like she claims, and is her strange behavior actually just her being Paula Abdul rather than drugs or alcohol? Was this a ploy for attention that ripped off of Gloria Estefan’s accident? Why did it take eleven years after the alleged accident for there to be a single documented mention of it? I’m very curious what everyone else thinks about this case.
My personal theory (which is based as much on gut feelings as it is on actual information, since the info is so spotty) is that she was on a plane during the Under My Spell tour, wasn’t wearing a seatbelt, and was injured when the plane experienced turbulence mid-flight. This compounded her existing spinal injuries and her condition deteriorated for several years until around 1994 her health problems prevented her from working. She took a break from the limelight to recover, came back for American Idol, and decided to embellish her story to garner sympathy and distract from the other issues (the relative commercial failure of Head Over Heels, her divorces) that contributed to her break. I’m unsure on whether or not she had an addiction to painkillers but I lean towards “no”. Her story of using alternative medicine in response to her injuries from the crash partially convinced me that the strange behavior people point to as proof of her being on drugs is actually just her being herself. She seems like a bit of an odd duck.

1 Some articles list 1993 as the date of the crash, including some quotes from Abdul herself, but in the grand scheme of things this did not seem particularly significant. The tour she mentions ran from 1991 to 1992, and most articles state 1992. Because of this I am assuming that this is a mistake rather than an actual lie. Specifically the 2009 Ladies Home Journal interview says she was in a car accident in 1992 that caused a neck injury, and places the plane crash in 1993. This is the closest thing to a “contradictory” date I have seen but it also is not a quote from Paula Abdul herself. Make of this what you will.
2 According to an edit in the Jezebel story, there was a Kansas City Star article claiming Abdul had performed in Kansas City on June 20, 1992, which would basically rule out a St. Louis to Denver flight. However, I’ve tried searching and can’t find this article. If anyone is able to find it I’d be happy to edit it in, but I’m not including information I can’t verify. The Cardinals defeated the defending NFC Champion San Francisco 49ers 24-20 in the season-opener at Levi’s Stadium on Sunday. With the victory, Arizona earned its first Week 1 win since 2015 and first Week 1 road victory since 2010.
• With the victory on Sunday, Arizona improved to 5-2 at Levi’s Stadium. The Cardinals also improved to 9-2 in their last 11 games against the 49ers.
• The Cardinals (who trailed 13-10 entering the fourth quarter) were one of six teams to come back to win after trailing in the fourth quarter on Kickoff Weekend (Chicago, Jacksonville, Las Vegas, the Los Angeles Chargers and Washington). The Cardinals defeated the defending NFC Champion San Francisco 49ers 24-20 in the season-opener at Levi’s Stadium on Sunday. With the victory, Arizona earned its first Week 1 win since 2015 and first Week 1 road victory since 2010.
• With the victory on Sunday, Arizona improved to 5-2 at Levi’s Stadium. The Cardinals also improved to 9-2 in their last 11 games against the 49ers.
• The Cardinals (who trailed 13-10 entering the fourth quarter) were one of six teams to come back to win after trailing in the fourth quarter on Kickoff Weekend (Chicago, Jacksonville, Las Vegas, the Los Angeles Chargers and Washington). That is the most fourth-quarter comeback victories on Kickoff Weekend since 2016 (nine teams).
• Arizona trailed 10-0 early and entered the fourth quarter trailing 13-10 but went on to earn the comeback victory. In 2019, the Cardinals were 0-7-1 in games they trailed entering the fourth quarter. Hi everyone I'm copying this post/format from u/rootb33r who is usually in charge of banner design submissions. I know he's got a lot on his plate right now so I figured I'd set up this initial post just to give people a heads up on what traditionally happens!
Like we've done for the past few seasons, we'll be doing community banners for each of the games. Last year we had some really good submissions so I'm looking forward to more this year.

I will guild anyone who helps me: Confusing wording on PUA led to mistakenly signing up for Colorado PUA instead of Hawaii UI... Unique situation. Am I screwed?
I will have my questions in bold on the bottom. I know it's a lot to read, and I don't expect anyone to know what to do, but this is in desperation. From one grateful human to another, thanks for any help you can offer.

Background:

I'm a 24-year old self-employed videographer and editor for the last few years. I moved back to Colorado in June 2019 after a short living period in Honolulu, Hawaii for 10 months. Other than self-employed work, I only had two W-2 jobs in Honolulu in 2019, one for $2,000 and one for $1,400. Other than that, all money I made was through self-employment. These two W2 jobs were one-time production jobs on-set, not a standard-W-2 employee "job".
Now, from June 2019 to December 2019, I continued work full time as a self-employed videographer in Denver, Colorado. I earned no W2 income during this period of time last year, only self-employed income. I don't make much.
When COVID hit hard in March 2020, all of my planned/booked events and productions for the foreseeable future were canceled or put on hold indefinitely or rescheduled. Each week I lost thousands in future income planned, and the situation looked more dire with every unfortunate phone call from cancelling clients.
I applied for the Pandemic Unemployment Assistance (PUA, basically Unemployment Insurance for self-employed citizens) program in Denver, CO, because I was self-employed, especially here in Colorado.
I applied for the PUA instead of regular UI based on the criteria posted on the Colorado.gov site below. Take special note in the wording of how they describe the way 2019 W2 income affects eligibility.
The wording describing PUA eligibility is confusing
I had made less than "$2,500 in wages on a W-2 from any employer", as shown here on the website. A single W-2 form from any employer. That's what this sentence says, does it not?
I had made less than $2,500 in wages on any single W-2 form, so I continued to application. I was approved and was diligent about my weekly certifications for 17 weeks until work started again.

For 17 weeks, I (thankfully) received this financial aid in the form of the PUA and an extra $600/week, keeping me and my business afloat.

But this morning (Sept 4th), I received this notice in my email:

Page 1 stating that my W2 wages were too much to qualify for PUA, and instead I should have applied for Hawaii Unemployment Insurance.

Page 2, indicating my entire PUA amount must be repaid.
After 17 weeks of PUA assistance plus the bonus $600/week helping me financially support myself and my now-struggling business of many years, I received this email on September 4th that stated my PUA was determined ineligible because I had "sufficient qualifying wages" to file a State Unemployment Insurance claim with the state of Hawaii. This was a shocking surprise because I had barely worked in Hawaii; nearly all of my income came from the majority of my year in Denver, Colorado. I had also only received up to $2,000 on one of my W-2's during my time in Hawaii, definitely under the maximum allowed to apply for the PUA.
Colorado's Department of Labor and Employment is now requesting I pay back the $13,991.00 that was used to support my basic needs during the pandemic period of unemployment.
Stupefied, I went back and looked at the requirements. I quote from the Colorado.gov PUA homepage as of 9/4/20: "If you received $2,500 or more in wages on a W-2 from any employer where taxes were withheld since January 2019."
Did I receive more than $2,500 in wages on any W2 from any employer? No. The most I made from a single employer on a W2 was $2,002.00. Hence why I applied for the PUA. This wording is not only confusing, but clearly makes its intentions out to focus on any single W-2 form.

Here are my questions:

  1. If I choose to try to appeal my case, do you think I have a case? The wording regarding "total W2 income" vs "a single w2 form of income" is definitely confusing and inaccurate, and is found in multiple locations on the website and throughout the application process. Should I try to appeal based on this confusing wording? Or is there another reason to appeal?
  2. Should I instead try to pay this back, and instead apply for Hawaii state unemployment, hoping Hawaii can retroactively pay me unemployment for the time listed in my PUA Determination?

2020.09.04 20:49 roccscout [Colorado] I will guild anyone who helps me: Confusing wording on PUA led to mistakenly signing up for PUA instead of Hawaii UI. Unique situation. Am I screwed?

I will have my questions in bold on the bottom. I know it's a lot to read, and I don't expect anyone to know what to do, but this is in desperation. From one grateful human to another, thanks for any help you can offer.

Background:

I'm a 24-year old self-employed videographer and editor for the last few years. I moved back to Colorado in June 2019 after a short living period in Honolulu, Hawaii for 10 months. Other than self-employed work, I only had two W-2 jobs in Honolulu in 2019, one for $2,000 and one for $1,400. Other than that, all money I made was through self-employment. These two W2 jobs were one-time production jobs on-set, not a standard-W-2 employee "job".
Now, from June 2019 to December 2019, I continued work full time as a self-employed videographer in Denver, Colorado. I earned no W2 income during this period of time last year, only self-employed income. I don't make much.
When COVID hit hard in March 2020, all of my planned/booked events and productions for the foreseeable future were canceled or put on hold indefinitely or rescheduled. Each week I lost thousands in future income planned, and the situation looked more dire with every unfortunate phone call from cancelling clients.
I applied for the Pandemic Unemployment Assistance (PUA, basically Unemployment Insurance for self-employed citizens) program in Denver, CO, because I was self-employed, especially here in Colorado.
I applied for the PUA instead of regular UI based on the criteria posted on the Colorado.gov site below. Take special note in the wording of how they describe the way 2019 W2 income affects eligibility.
The wording describing PUA eligibility is confusing
I had made less than "$2,500 in wages on a W-2 from any employer", as shown here on the website. A single W-2 form from any employer. That's what this sentence says, does it not?
I had made less than $2,500 in wages on any single W-2 form, so I continued to application. I was approved and was diligent about my weekly certifications for 17 weeks until work started again.

For 17 weeks, I (thankfully) received this financial aid in the form of the PUA and an extra $600/week, keeping me and my business afloat.

But this morning (Sept 4th), I received this notice in my email:

Page 1 stating that my W2 wages were too much to qualify for PUA, and instead I should have applied for Hawaii Unemployment Insurance.

Page 2, indicating my entire PUA amount must be repaid.
After 17 weeks of PUA assistance plus the bonus $600/week helping me financially support myself and my now-struggling business of many years, I received this email on September 4th that stated my PUA was determined ineligible because I had "sufficient qualifying wages" to file a State Unemployment Insurance claim with the state of Hawaii. This was a shocking surprise because I had barely worked in Hawaii; nearly all of my income came from the majority of my year in Denver, Colorado. I had also only received up to $2,000 on one of my W-2's during my time in Hawaii, definitely under the maximum allowed to apply for the PUA.
Colorado's Department of Labor and Employment is now requesting I pay back the $13,991.00 that was used to support my basic needs during the pandemic period of unemployment.
Stupefied, I went back and looked at the requirements. I quote from the Colorado.gov PUA homepage as of 9/4/20: "If you received $2,500 or more in wages on a W-2 from any employer where taxes were withheld since January 2019."
Did I receive more than $2,500 in wages on any W2 from any employer? No. The most I made from a single employer on a W2 was $2,002.00. Hence why I applied for the PUA. This wording is not only confusing, but clearly makes its intentions out to focus on any single W-2 form.

  1. If I choose to try to appeal my case, do you think I have a case? The wording regarding "total W2 income" vs "a single w2 form of income" is definitely confusing and inaccurate, and is found in multiple locations on the website and throughout the application process. Should I try to appeal based on this confusing wording? Or is there another reason to appeal?
  2. Should I instead try to pay this back, and instead apply for Hawaii state unemployment, hoping Hawaii can retroactively pay me unemployment for the time listed in my PUA Determination?

Routing Your Tour

Google maps is your best friend when routing a tour. Route your shows so that you don’t have to drive more than 8 hours at a time, preferably 4 hours (with a 2-hour grace period) if its the same day as a show. Your region will affect this — The NorthEast has markets less than an hour apart, while the SouthEast has market at least 3 or 4 hours apart. The MidWest has even further markets, with some drives hitting 6 or 7 hours. Time zones will also affect your DOS (Day Of Show) arrival, so keep them in mind when driving East or West. In some cases, the load in times may be absurdly early — For example a 3pm Soundcheck for an 11 pm show, which will affect your routing. Lastly, always assume that there is going to be traffic, so give yourself a generous grace period when driving through any major city.
“When sending out holds to promoters, group them together by region as to avoid backtracking. Sometimes its too early to have an idea of your competition, but do your best to avoid markets that would be big competition unless you can leverage your way into that competition. For example, I wouldn’t book a show in Atlanta during the weekend of Sweetwater’s 420 Festival unless you are able to secure an Official After Party or Pre-Party show.” (Erwin Schemankewitz)

Lets breakdown an example of some Bad Routing

This is a real tour route that I saw a musical contemporary of mine post on their social media. Without lambasting anyone, I would like to break down the good and bad qualities of this route.
Non-hypothetical Tour Routing - Good vs Bad?
First of all, this routing is not all bad. If you were touring in a bus or had a dedicated driver, this route makes a lot of sense. All of these 5+ hour drives can be done at night while the artist is asleep in the bus. But if you are driving a van (which you definitely are if you are reading this), this cramped route will leave you exhausted by the end.
My biggest complaint is that with only a single day-off sandwiched inside 16 gigs, the feasibility of this route is ambitious. Adding driving times into the mix, and it becomes absurd. If the cities were closer together, or you played multiple nights in the same city, that would be different. But there is little breathing room in this tour to break the monotony of driving, loading in, performing, and loading out (which can drive you insane after a while). A more reasonable tour schedule would grant the artist 2 days-off for every 5 shows on (typically on the Sunday & Monday since its hard to book shows on those days anyway). So a 16-show route like this would ideally have 3 or 4 days-off sprinkled in between, or to help connect a long drive.
Other than days-off, this route fails to account for travel delays in a few major areas: Big Cities (+ 1 hour), Border crossings (+ 1 hour), and Traffic. These 3 hours drives turn into 4, and the 5 hour drives turn into 7. Even if everything went 100% according to plan, and you are the most timely band in the world, there is so much uncertainty on the road that this routing would make me anxious about arriving at our venues on-time. Not to mention that the long drives would assuredly take a toll on the quality of the performances, night after night.

How to Classify Markets:

In the Live Concert & Touring industry, markets (cities) are classified into three sizes: Tertiary Markets (smallest), Secondary Markets (middle), and Primary Markets (largest).

Tertiary Markets

Tertiary Market: the smallest of the three classification of market size. This is a small city or town, somewhere with a population of less than 50,000 people. Doing well in these markets can be attributed to a limited nightlife and music scene. Or its the hometown of one of your band members and you pack the club out with your local friends. These markets typically do not have theaters, but small clubs or large bars. This market sells 50–1,000 tickets.
Tybee Island, GA

Secondary Markets

Secondary Markets: The middle classification of market size. The majority of your touring will be spent in Secondary markets. These are small — large cities with populations between 50k and 1 million. These markets have large theaters, developed arts communities, and an active nightlife. This market sells 200–5,000 tickets.
Asheville, NC

Primary Markets

Primary Markets: These are really big cities: LA, Atlanta, Dallas, New York City, Toronto, Seattle, Nashville, Boston, Chicago, etc. Success in Primary markets is crucial to a booking agent because these markets are the most scalable. An artist can grow from 500 tickets sold to 50,000 in the same city. Routing a tour through Primary markets is easier and more lucrative for all parties involved.

How to Interact with the Promoter

How often do you follow up with a Promoter if they don’t respond to your email?

“For a cold lead, You can start reaching out to promoters as early as 6 months in advance of the show or hold requested. When sending cold emails, you should email a ton of venues all at once, like throwing darts at a dartboard. Most will be misses, but some will stick. And you can lock those in to build your route. Focus on regional batches. For Example, ask for holds during a 2 week period in Northern California/West Coast, and then the following 2 week period in Southern California/SouthWest.”
“After about a month of tricking emails and correspondence, you can send you follow ups to all the cold leads who did not respond (which will be most of them). Make sure before you follow up that you check the event calendars for these venues. Do your due diligence to make sure that date is publicly available on their end. Once you are in the 2-month time frame, you can begin sending follow ups once a week until a route is locked in.”
“90% of the time, promoters are appreciative that the booking agent is staying on top of the show with weekly follow up. They may have read you initial email, made a mental note of the show, but forgotten to write back. You never know if your emails are going into a spam folder or how busy the promoters are. Most likely, you will receive curt emails like “not available”, “no”, or “OK”, from promoters when trying to book a show. These people are very busy! But for the most part, the promoter will not be annoyed with follow ups about a show, as long as the show is publicly available, because that’s how the business works.” (Erwin Schemankewitz, Ever Upward Entertainment)

Keep your emails short and sweet

When emailing a promoter or venue, keep your emails short and sweet: Include pertinent information only!
Hypothetical email looking to secure a Hold from a Promoter
They don’t need your bio, or a persuasive argument about why your band should receive priority on the show. Do not send any attachments on the email. Instead, format the body of the email with hyperlinks, such as to the bands website, social media, or a spreadsheet of their history in that market. Lastly, do not inflate you numbers! If you can only draw 50 people, that’s fine. There is room for you in the market to grow and promoters understand this. The deal structure will reflect those numbers, of course. But at the end of the day, the market decides. And if you tell the promoter you can bring 200 people and sell 40 tickets… you won’t be invited back.

Pay Attention to the Radius Clause

A Radius Clause is a time frame or geographic restriction that prevents an artist from playing a competing show. Standard radius Clause is 60 Days and 60 Miles and can be found in the performance Contract. It gives the promoter a form of territorial exclusivity over the performance. If get caught breaking a radius clause, that is legal justification for the promoter to remove you from the show. Radius Clauses are almost always found in contracts for soft-ticket events, so an event where you are not the main attraction such as a music festival. Make sure you or your manager is reviewing every performance contracts just in case. Failing to uphold your Radius Clause looks really bad on the artist and the management.

The Deal is The Deal

You can assume that the venue is lowballing on their first offer, but generally there is very little room for negotiation on a Performance Contract. Especially in the areas of hospitality, the venue will offer what they are capable of up front. In the case of a larger food buyout or a paid-for hotel room, this isn’t something that can be leveraged against the promoter. If the venue has a runner, they will be upfront about it. If the venue has a loft for the band to sleep in, they will be upfront about it.
For negotiating the Artist’s Performance Fee, the market will decide. If you can sell 50 tickets vs 500, your payment will accurately reflect that. Some venues have successful weekday show series, like a Monday Funk Night that will generate more revenue than normal. However you should consider Sunday through Tuesday to be off days or bad deals. For example, a door deal at a bar in an unfamiliar market might not even be worth the trip out there, unless it routes you to a better market later in the week.

Consider the Underplay

It is easy to get caught up in the numbers game. And that’s because the most important component of social marketing is non-quantifiable. You can’t turn it into numbers. You can’t measure it, you can only measure the results. That thing, is HYPE. An Underplay, is a show that is guaranteed to sell-out because the venue capacity is so much smaller than the expected attendance.
While this strategy might not work for you financially, a close-to-home and stripped down version of your set can be great for building a community.

Don’t take anything personally

Whatever happens, and only as long as you have done your due diligence, problems with routing and getting shows probably has nothing to do with you. The Music Business is a whirlwind of chaos, email threads, lost communication, and alcoholism. Sometimes things that seemed perfect on paper don’t work out. Sometimes responsible people make mistakes. Sometimes the show gets double booked, or the headliner gets stuck in traffic. Bands are a business, and business should never be taken personally. You just have to roll with the punches.

2020.08.31 18:04 impicklerickbtch Can my landlord make me pay for September rent after asking us to move out by August 31st? Denver, CO

My roommate and I are renting a house in Denver, CO. Our lease is from July 1, 2019-September 30, 2020. At the beginning of August we asked our landlord if we could terminate our lease a month early — my roommate is moving into her new apartment September 1st and I’m moving to Utah for a new job after losing mine due to COVID. In response to our request, our landlord said he would be flexible around the end date. On August 27, he asked us if we could be moved out by August 31 (we have this in a text message conversation), to which we agreed and scrambled to be moved out by this weekend. Today, August 31, we texted him that we would be completely moved out by the end of today and asked how to proceed regarding security deposits and whatnot. He then tells us he hasn’t found anyone to move in yet, so we still have to pay for September rent.
This is where I’m looking for advice, since he asked us to be out by August 31 and we have the text conversation, can he go back on that and still make us pay for September?
Edit: I was hoping for some small loophole because of his text message asking "You guys think you could get moved out by this 31st?" I worry we weren't specific enough in our request. I also suspect his efforts to find new tenants were minimal.
Many of you also suggested that I ask if he can keep my security deposit (which is actually more than my part of the rent) in lieu of September's rent. I think I will go ahead with this idea and the excess money can be used for the cleaning, though I don't anticipate that being very much.
I'm mostly just disappointed and maybe acting rather emotionally about this situation because I was looking forward to saving $1000+. I won't start my new job for a couple more months, so the money situation is just a bit scary for me at the moment. It shall all turn out ok, though. I thank you all for your help and advice!
Update: Firstly, thank y’all for the advice! I had come to the conclusion to use this situation as a learning lesson. That is, however, until I caught my landlord coming into the house while we weren’t there and without notifying us beforehand. It very clearly states in our lease that he must give us 24 hours notice. Does this mean he broke our lease?
